Terms and Conditions
(Photography Services)
1. Scope
These terms apply to all photography, video and related services provided by Paul Schmidt ("the photographer") to a client ("you"). They cover real estate and property photography, hotel, lodge and rental photography, content packages, and portrait sessions.
By requesting a quote or booking a shoot, you agree to these terms. Different terms apply only if the photographer has agreed to them in writing.
2. Quotes and bookings
A quote describes the service, the date or time window, the number of delivered images or clips, the fee and any extra costs. Quotes are valid for 14 days unless stated otherwise.
A booking is confirmed when you accept the quote in writing (email or message) and pay the deposit, if one applies. Until then, the date is not reserved.
Changes to the scope, such as extra locations, more images or a rush delivery, need the photographer's agreement and may change the fee.
3. Fees, travel costs and payment
All prices are in US dollars and are stated before taxes where taxes apply. "From" prices on the website are a guide; the quote is the binding price.
Travel, transport (for example plane, boat or ferry), accommodation and permit costs outside the photographer's current location are quoted separately and agreed in advance.
Payment is due within 7 days of delivery / before delivery for new clients by bank transfer, PayPal, crypto or other method. For bookings that include travel expenses, a deposit is due to confirm the date. Delivery of final files may be withheld until full payment is received.
4. Cancellation and rescheduling
You can reschedule or cancel free of charge up to 48 hours before the agreed start time. After that, 50% of the fee is due, and the full fee if the photographer is already travelling or on site.
Outdoor, exterior and drone shoots depend on weather and light. If conditions are unsuitable, either side can move the shoot to the next suitable date without charge. A weather reschedule is not a cancellation.
If the photographer has to cancel, for example because of illness or an unforeseen travel problem, you will be offered a new date or a full refund of any deposit.
5. Delivery of images
Edited images are delivered as high-resolution JPEG files through an online gallery or download link, within 48 hours for a standard listing shoot and within the time stated in the quote for other work. Delivery times are estimates and can be longer where travel or internet access is limited.
The photographer selects and edits the images. Natural edits such as colour, exposure, perspective and removing small distractions are included. Unedited raw files are not delivered unless agreed in writing.
Please check the delivery within 7 days and report any problem. Reasonable corrections are made free of charge. Images are not materially changed in ways that would mislead viewers about a property.
6. Copyright and usage rights
The photographer owns the copyright in all images and videos. The photographer's name may be shown as credit where reasonable.
After full payment, you receive a non-exclusive, non-transferable licence to use the delivered files for the purposes stated in the quote, for example your website, booking platforms, listings, social media and marketing. The licence has no time limit.
Not included without written agreement: resale or sublicensing of the images, use by third parties other than your agents and booking platforms, and use in large advertising campaigns. Exclusive rights and wider licences can be agreed for an additional fee.
Removing the photographer's credit or metadata where it was agreed, or using the images in a misleading way, is not allowed.
7. Client responsibilities, access and permissions
You confirm that you own the property or are authorised to have it photographed, and that you will arrange access on the agreed date. Please have the property clean, tidy and ready before the photographer arrives. Waiting time or a repeat visit caused by an unready property may be charged.
You are responsible for permissions needed from owners, guests, tenants, staff or neighbours, drone operation, and for any permits or fees charged by the location. The photographer is not responsible for images that cannot be taken because access or permission was not given.
Guests and personal items may appear in photographs unless you ask for them to be removed or avoided beforehand.
8. Portraits, people and releases
For portrait sessions, the photographer will agree the time, place and style with you in advance. Please arrive on time, because late starts shorten the session rather than extend it.
The photographer will not photograph identifiable people for use in commercial or promotional material without their consent. Where you want the photographer to use images with people in them, you confirm that those people agree.
Portraits and travel images are delivered in an edited selection. The number of images depends on the session and light and is not guaranteed.
9. Drone photography
Aerial images are offered where local rules, weather, airspace and safety allow. The photographer flies in line with the rules of the country or area and may decline or stop a flight if conditions or rules do not permit it. Where permits or landowner permission are required, you will be told in advance and the cost, if any, is quoted separately.
If a drone flight cannot be done for these reasons, the fee for the aerial part is not charged or is refunded.
10. Portfolio and promotional use
The photographer may use the images in his portfolio, website, social media and self-promotion, and may name the client or property as a reference, unless you ask otherwise in writing before the shoot. Where this is done, the photographer will not publish private details such as door numbers or security information.
If you do not want an image shown publicly, tell the photographer after delivery and it will be removed from future use.
11. Liability, force majeure and complaints
The photographer takes reasonable care of your property and of the delivered files. Liability for damage is limited to cases of intent or gross negligence and, where the law allows, to the fee paid for the booking. The photographer is not liable for indirect losses such as lost bookings or sales. Nothing in these terms limits liability that cannot be limited by law.
The photographer is not responsible for delay or failure caused by events outside reasonable control, such as severe weather, illness, accidents, travel disruption, power or internet failure, or official restrictions. In such cases the shoot is rescheduled or, if that is not possible, refunded in proportion.
The photographer keeps delivered files for 24 months after delivery. Please keep your own backup.
If you are not happy with the work, tell the photographer in writing within 7 days of delivery so that it can be put right.
12. Governing law and final provisions
These terms are governed by the law of Curaçao. Disputes will be settled by the competent courts of Curaçao.
If a part of these terms is not valid, the rest stays in force. The photographer may update these terms. The version that applies is the one in force when the booking was confirmed.
